MEDIA STATEMENT BY YB NGA KOR MING, MP FOR TAIPING
It is extremely shocking when the people of Perak received the news that all the eleven(11) election petitions filed to challenge the election result against Barisan Nasional were recently all dismissed on technical ground without the petitioners be given the right to be heard.
The is so especially in Perak, 55.14% of the voters voted for PR candidates compare with only 44% voted for BN.
In all the 11 election petitions, the pertinent fact is no witness is allowed to be called and no evidence is allowed to be tendered in court, but all cases were dismissed summarily.
The ground of dismissal is simple, to put in lay man term, that the notice of filing is wrong.
As such, the lawyers are not allowed to advocate in court and even the petitioners are not allow to speak for himself. No cases filed by Pakatan are allowed to proceed with full hearing so far.
It is also shocked to see the result of the election petitions especially the latest amendment to the court rules which had stated that no case shall be dismissed simply based on technical reasons.
What is even more shocking are, the petitioners in Perak, all from Pakatan Rakyat, are now ordered to pay a whopping cost totaling RM965,000.00! , with each ranging from RM25,000 to RM120,000.00.
We found that this is extraordinary as under the 1954 Election offences Act, the judge is not allowed to award cost but to tax it before the registrar.

MCA youth secretary Chai Kim Sen is advised to first and foremost find out the truth rather than relying on hearsay before levying the attack on DAP Perak with the allegation of “Land in exchange of MBship”
Chai has urged Perak DAP chief Ngeh Koo Ham and State Secretary Nga Kor Ming to declare their assets alleging that they had received gratification from PAS.
In his statement 2 days ago, Ngeh explained and clarified the full background of the land dealings, but Chai has refused to take this clarified stance.
Chai, in his statement, asked why DAP has supported a PAS State Assemblyman to be the MB as DAP is holding the most number of state seats. If there are any doubts, Chai should ask himself and MCA, why there are still restrictions in the Perak Constitution after 51 years, whereby the MB must be of Malay race.
If Chai is unsure about the history and background of the appointment of the MB, he is to be reminded now that the 3 parties in PR had submitted one nomination each for the MBship, that is Mohd Nizar bin Jamaluddin for PAS, Ngeh Koo Ham for DAP and Mohamad Jamaluddin for PKR. His Royal Highness, the Sultan of Perak had chosen among them, Dato’ Seri Mohd Nizar to be the MB. Is Chai and MCA now questioning the prerogative and decision of the Sultan?

A pro BN blog, Pisau.net maliciously claimed that Kelantan Menteri Besar, Tok Guru Nik Aziz approved to me and YB Nga Kor Ming 10,526 acres of land in exchange for our agreement to appoint Dato’ Seri Nizar Bin Jamaluddin as Menteri Besar in 2008.
The claim in Pisau.net is a blatant lie. UMNO knows the truth about the said land but pro BN media continue to cause confusion and therefore I feel the need to issue this media statement.
I have on 19/12/2012 lodged a police report for action to be taken under Section 8A (Offence for publishing false news) of the Printing Presses and Publication Act 1984 and Section 499 (Criminal Defamation) of the Penal Code against those who defamed Tok Guru Nik Aziz, YB Nga Kor Ming and me. I have instructed my lawyer to take legal action against those who have defamed YB Nga Kor Ming and me.
I would like to reiterate that neither YB Nga Kor Ming nor I was given any land by the Kelantan Government. The acquisition of Upayapadu Plantation Sdn Bhd together with other investors in April this year (2012) was a commercial transaction purchased in the open market.

The Perak Barisan Nation State Government and Menteri Besar Dato’ Seri Zambry Abd Kadir is urged to stop avoiding the issue and start explaining why the state government has allocated, without open tender and at a low price, 147 acres of prime land in Lumut and 32 acres in Kamunting to private companies.
In the most recent assembly sitting, Dato’ Seri Mohd Nizar bin Jamaluddin said that in the company awarded the 32 acres of land in Kamunting, one of the shareholders is closely related to the BN Youth Chief. The company awarded the land in Lumut, is said to be close to Zambry himself
When Nizar’s debate was interjected, Zambry confidently said that he will reply and “wait for Friday”, which is during the winding up speech. However, he has failed to respond to any of the accusations levied against the State Government.
